Terms of Service

These Terms of Service ("Terms") govern your access to and use of Base Momentum, a decision- intelligence platform for app developers, part of the Kabooshe Apps ecosystem ("Base Momentum," "we," "us," or "our"). Base Momentum is operated by Mohammed Almadhoun (see Section 13). By creating an account or using Base Momentum, you agree to these Terms. If you don't agree, don't use the service.
1. The service
Base Momentum analyzes publicly available app store listing data and, where you explicitly authorize it, developer-account data, to help you understand your app's performance and prioritize what to fix next. Every score, diagnosis, and recommendation Base Momentum shows you is clearly labeled with how it was determined — Observed, Authorized, Estimated, or Unavailable. We never present a value we couldn't actually determine as if it were real data, and we never fabricate evidence to fill a gap.
Base Momentum does not track earnings or ad revenue (that's My Base) and does not manage tester recruitment or feedback campaigns (that's Testers Base). Where relevant, Base Momentum links to those products instead of duplicating their functionality.
2. Accounts
- You must provide accurate information when creating an account and keep your login credentials secure.
- You're responsible for all activity that happens under your account.
- You must be legally able to enter into a binding contract to use Base Momentum.
- One account represents one organization. If you need multiple team members with access to the same organization, that capability isn't available yet — contact us at info@kabooshegames.com.
3. Plans, billing, and the Price Lock Guarantee
Base Momentum offers a Free plan, paid Pro and Studio subscription plans billed monthly or annually, and Enterprise arrangements for larger studios negotiated directly with us. Paid Pro/Studio subscriptions are processed by Paddle.com, acting as our Merchant of Record — Paddle handles your payment method, applicable sales tax/VAT, and receipts. Base Momentum never receives or stores your full card number.
Price Lock Guarantee: for a qualifying Pro or Studio subscription, the price you subscribe at is locked for that specific subscription for as long as it remains continuously active under the conditions described here. If we later raise prices for new customers, your existing, continuously active subscription keeps its original price. This is a promise about the subscription's price under its stated conditions — it is not a promise of lifetime service, and it does not apply to Enterprise arrangements unless we explicitly agree otherwise in writing.
If your subscription is cancelled and actually ends, and you later start a new subscription, that new subscription is charged whatever price is current at that time — your previous locked price is not automatically restored. Voluntarily switching plans (for example Pro to Studio) or switching between monthly and annual billing also moves you to the currently available price for the new plan or interval, not your previous locked price.
Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You can cancel at any time from Settings → Billing & Subscription; cancelling stops future renewal but does not refund the current billing period — see our Refund Policy for details on refunds.
4. Service availability and third-party data
We aim to keep Base Momentum available and reliable, but we don't guarantee uninterrupted access — maintenance, third-party outages, or issues beyond our control can affect availability from time to time.
Base Momentum depends on data from third parties outside our control, most importantly public app store listing pages. We can only show evidence we can actually retrieve, and we clearly label evidence we couldn't retrieve as Unavailable rather than guessing. 5. Plan limits and entitlements
Each plan includes specific limits (for example, the number of apps or competitors you can track). These limits are enforced by our servers, not just shown in the interface.
If a downgrade (including a subscription ending) puts you over your new plan's limits, we never delete your existing apps, competitors, or their stored data solely because of that downgrade. Any resources above your new plan's limits are retained and remain visible in your account, but may become inactive/read-only for ongoing processing. You can choose which eligible apps and competitors stay active within your new plan's limits.
You can't activate or add a new app or competitor beyond your plan's limits unless you deactivate another eligible resource or upgrade to a plan with a higher limit — resources aren't automatically reactivated if you upgrade again later.
6. Acceptable use
You agree not to:
- Use Base Momentum to scrape, spy on, or collect non-public data about any app, developer, or user.
- Attempt to circumvent rate limits, authentication, or the organization-isolation boundaries of the service.
- Use the service to submit fake reviews, manipulate rankings, or otherwise violate app store policies.
- Resell or provide access to Base Momentum to third parties without our written permission.
- Reverse-engineer, decompile, or attempt to extract the source code of the service.
- Use the service in any way that violates applicable law.
7. Data you connect or import
When you add an app, Base Momentum reads that app's public store listing page — information already visible to anyone. If you choose to connect a developer console account (a separate, explicit authorization step), we only access what that authorization grants, and you can revoke it at any time from Settings. See our Privacy Policy for details on what we do and don't collect.
8. Intellectual property
Base Momentum, its logo, and its underlying software are owned by us and protected by intellectual property law. These Terms don't grant you any ownership rights in the service — only a limited right to use it as intended. You retain ownership of the app and business data you connect to your account.
9. Disclaimers
Base Momentum provides analysis and recommendations based on the evidence it can actually observe. We clearly label evidence quality, but we cannot guarantee that following a recommendation will improve your app's performance, ranking, or revenue. The service is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, Base Momentum will not be liable for indirect, incidental, special, or consequential damages arising from your use of the service, including lost profits or lost data, even if we've been advised of the possibility of such damages. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.
11. Termination
You can stop using Base Momentum and cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms, including the acceptable-use rules above. If we terminate your account for cause, we'll tell you why where legally possible.
12. Changes to these Terms
We may update these Terms as the service evolves. If we make a material change, we'll update the "Last updated" date above and, where required, notify you directly. Continuing to use Base Momentum after a change takes effect means you accept the updated Terms.
13. Legal operator and governing law
Base Momentum is operated by Mohammed Almadhoun as an individual, not through a separate incorporated company. These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict-of-law principles, subject to any mandatory consumer protections that may apply in a user's country of residence.
